MEMBERSHIP POLICIES & DOJYM RULES

Elevo Dynamics designed the Membership Policies and the DOJYM Rules, to include rules listed here as well as those posted in the DOJYM, to ensure a safer and more enjoyable environment in which to exercise and train. Please be thoughtful and observe the Policies and Rules that you, and all members, have agreed to abide by. Elevo Dynamics maintains the right to modify any of the Policies and Rules at any time without notice. It is your responsibility to know and follow the most current Policies and Rules. All approved signs posted in the DOJYM or on the premises shall be considered a part of the Policies and Rules of Elevo Dynamics.

The following Policies/Rules replace all previous Policies/Rules. If there is any conflict between these Policies and the posted DOJYM Rules, these Policies/Rules apply.

EQUAL OPPORTUNITY POLICY STATEMENT

Elevo Dynamics seeks, enrolls and maintains memberships without regard to race, religious creed, color, national origin, ancestry, any disabilities or conditions, marital status, sex, sexual orientation or age. It is further DOJYM policy that no circumstance or conduct undertaken by DOJYM personnel shall have the effect of discrimination on the basis of any of the aforementioned classifications.

PRIVACY

Please consult our Privacy Policies for a description of our practices with respect to collection, sharing and privacy of your personal information.

 CHECK-IN

With your membership, you will be enrolled in our key-card system. The key-card will be personalized with your name downloaded on it. This will allow you access to the DOJYM 24 hours a day. When you use the card to enter into the DOJYM, a log is created in our system, therefore it is important that every member scan their card (even if you come with a friend, spouse, etc. No exceptions). If your card gets stolen or lost and needs to be replaced, there will be a $20 fee for a replacement card.

MEMBERSHIP FREEZE & CANCELATION POLICY

Qualification and Notice Requirements: Elevo Dynamics will only freeze your membership if you are in good standing, you have all initiation fees paid, you are current on your monthly dues, you provide at least Thirty (30) days (Four weeks) before your next billing, Written notice on a Freeze Request Form to allow Elevo Dynamics to process your request, and you qualify for one of the three (3) categories below:

Medical Disability: You must provide Elevo Dynamics with verification from your physician stating that your medical disability will prevent you from using Elevo Dynamics’ facilities. The minimum term for a medical freeze is three (3) months and the maximum is six (6) months. If the disability renders you unable to use the facility and/or the facility services for longer than  (6) months then you will be able to cancel provided you have documentation that proves your disability is the cause of your need to cancel.

Active Duty Military Transfer or Extended Volunteer Assignment: You must provide Elevo Dynamics with a copy of your transfer, deployment or extended volunteer assignment orders. The minimum time for a freeze is 3 months. The maximum time for a freeze is 12 months. Your membership and monthly Electronic Funds Transfer (EFT) or credit card charge will automatically resume at the end of the specified time.

Temporary Employment Transfer: You must provide Elevo Dynamics with verification from your employer, on company letterhead, that you are being temporarily transferred. The minimum term for a temporary employment transfer freeze is three (3) months and the maximum freeze is six (6) months.

-Dues During Freeze or Cancellation: Once Elevo Dynamics approves a membership freeze, no further dues will be collected with respect to such time. Your right to use Elevo Dynamics’ facility will be frozen or suspended, and Elevo Dynamics can deny you access to the DOJYM during such freeze. In the event your membership is prepaid, the term of the prepaid membership shall be extended, without further dues, for the same period of the freeze. Except for military freezes greater than six (6) months but less than (12) months, your membership will be reactivated and your monthly EFT or credit card payment will automatically resume at the end of your freeze period.

-Freeze Request Decisions: If your request does not conform to this Membership Freeze and Cancellation Policy, you will be notified that your request has been denied and your membership shall remain active. (Any unethical actions such as calling the bank or credit card company to freeze our rightful draft will result in a breach of contract and will be motioned to resolve in court.) Your contract is considered binding by law and should be ethically completed.

-Relocation Cancellation: If you relocate permanently (or for a period longer than 6 months) from the address you where at when entering into an agreement with Elevo Dynamics and that address is forty (40) miles away from Elevo Dynamics or one of its franchises you may be eligible for a cancellation of your agreement. You will need to have proper documentation (proof of address change: bill with your name on it, military orders, etc. or if this is for a youth; proof that their primary guardian is relocating. If the youth is moving to stay with another guardian, proof would have to be presented as well). This proof will have to be turned in with a written request Thirty (30) days prior to your next bill date. In the event that the facility relocates fifteen (15) miles away from the location it was at when you entered the agreement, AND this distance is greater than fifteen (15) miles from your current residential address, your membership can be canceled by written request turned in tThirty (30) days before your next payment is scheduled.

Note: In all the above situations you will have to provide proof twenty-one (21) days prior to your next due payment or this payment will be charged as scheduled.

GUEST PRIVILEGES

Elevo Dynamics encourages you to bring friends, relatives and business associates for a guest visit. You are required to schedule an appointment with the staff of Elevo Dynamics prior to your guest’s visit. A tour and orientation is required (for first time guest). You may only bring your guest in during day time hours while a staff member is on duty (12am to 8:30pm Monday-Thursday; 12am to 4pm Friday; 10am to 4pm Saturday). A guest must check in at the front desk, be at least 18 years of age, sign a medical and injury release form before being allowed to use the Elevo Dynamics facilities (a parent or legal guardian may bring a 14 to 17 year old minor as a guest if the adult member agrees to sign the appropriate release forms). A member can only bring a maximum of two guests at a time. A guest can only use the facility once under the guest policy, after which time the guest should purchase one of the various membership options. It is the responsibility of the member to inform their guests about these Policies. Failure to adhere to these guest policies will result in membership suspension or termination, on a case by case basis.

USE OF ELEVO DYNAMICS FACILITIES

Availability of Facilities: Elevo Dynamics facilities or services, including but not limited to, classes or equipment, may have limited hours, be discontinued altogether at any time, or be offered on a “first come first serve” basis. Elevo Dynamics reserves the right to charge a separate participation or reservation fee for any or all of these facilities or services. Use of Elevo Dynamic’s facilities or services are authorized and limited pursuant to your membership agreement.

Conflicts Regarding Use: Please do not linger on the equipment, due to the fact that other members may want to use it.  No member should monopolize the equipment or weights. If there is a sign-up list for use of the equipment, and a maximum time limit on its use, the directions for the use of the sign-up list are part of the DOJYM Rules, and Elevo Dynamics expects all the members to follow them. In short, observe DOJYM etiquette. If there is a conflict over use, let Elevo Dynamics management resolve it.

Regarding Specialty Classes and Personal Trainer Sessions, Elevo Dynamics has specific procedures and Rules, and may charge you for the use of the specialty classes and personal trainer sessions. Please see the front desk or read the posted information for these activities.

Weights and Other Equipment: There are specific Rules posted regarding the use of the weights and other equipment in the Elevo Dynamics facility. As a courtesy, please replace the weights on the rack after you use them and wipe off any benches, seats, back rests, etc. after your use. Wiping off equipment with towels you use to wipe your sweat is unacceptable; in the same vain just sitting a towel over the equipment is unacceptable (this does not negate that the equipment will have to be wiped down). You must use the clean wipes provided by the facility to wipe down all the equipment you use and failure to do so will result in termination of facility usage.

No member should stand or step on a piece of equipment not specifically designed for that. No member should sit weights or other heavy and potentially damaging items on equipment not specifically designed for such items to be placed on.

No Solicitation: The Elevo Dynamics facility is provided for the private use of DOJYM members only and is not open to the public. Any solicitation within the DOJYM is absolutely forbidden. This includes, for example: solicitation for profit, political purposes or any other reason; use of petitions; distributing or posting leaflets, notices, or advertising anywhere in the DOJYM facility; or leaving multiple copies of leaflets with the intent of solicitation.

GENERAL POLICIES FOR MINORS

Minors Under 14: May not use Elevo Dynamics facilities at any time and are prohibited from being on the DOJYM floor (where there is weight and exercise equipment). No minor should be upstairs unless supervised by an adult during a special event (nerf wars, etc.).

Minors 14 -17: May not use Elevo Dynamics’ facilities without being accompanied by a parent or guardian. They will not be allowed access to a key-card, and thus will not be subjected to any key-card fees. Parents of minors aged 14-17 must also be a member of Elevo Dynamics, and will be issued a working key-card, allowing access to the 24 hour facilities for both parent and minor. Any abuse of this policy will result in member termination, as it is a liability for the member, the minor, and Elevo Dynamics.

LOCKERS

Elevo Dynamics provides lockers for your use on a daily basis only and suggests that you use a lock to protect your property. Do not leave any valuable property in a locker at any time. Elevo Dynamics is not responsible for any theft of or damage to your property. If you leave a lock on the locker overnight, Elevo Dynamics has the right to cut it off and will do so. Elevo Dynamics will consider your property abandoned if left overnight. If you leave your property overnight, Elevo Dynamics shall have the right to donate your property to charity.

PROHIBITED ITEMS AND ACTIVITIES

No Alcohol, Drugs, or Smoking: Engaging in any activity at Elevo Dynamics while under the influence of illegal drugs or alcohol is strictly prohibited. Elevo Dynamics does not permit smoking, alcohol, or use of illegal drugs, including steroids, anywhere on the premises. Failure to follow these rules will result in immediate cancellation of your membership.

No Weapons: No weapons of any kind are permitted in the Elevo Dynamics facilities at any time.

No Photographic or Video Equipment: No photography, videotaping, filming or audio recording in the Elevo Dynamics facility without prior written approval/permission of the management.

Food and Beverages: Elevo Dynamics reserves the right to limit the consumption of food or beverages in the facility. No food is allowed in the equipment areas. Beverages such as water, Gatorade, and protein shakes are only allowed in non-glass containers with lids. No alcoholic beverages are allowed on the premises at any time.

Personal Training: No member may train another member for compensation. If Elevo Dynamics determines that such training occurs in the Elevo Dynamics facility, the trainer and/or trainee may lose their membership.

Outside Equipment: Elevo Dynamics reserves the right, in its sole discretion, to limit or restrict the use of outside equipment in the DOJYM.

DRESS/TOWEL POLICY

Elevo Dynamics requires you to wear appropriate clothing and footwear while in the facility. Here are some general guidelines: DOJYM shorts, T-shirts, jogging, aerobic and sweat outfits are permissible for exercising or aerobics, but street clothes/shoes and jeans are not. Speedos, low skirts, or short shorts are not permitted. You must have a towel with you during workouts to protect the machines you use. Sanitizing towels will be provided for you to wipe down the seats, back rests, arm pads, leg pads and handles of all equipment after use.

CONDUCT

While in the Elevo Dynamics facility, Elevo Dynamics does not permit and will not tolerate any inappropriate conduct. Such conduct includes, but is not limited to: using loud, abusive, offensive, insulting, or demeaning language; profanity; lewd conduct, or any conduct that harasses others or is bothersome to members, guests, or Elevo Dynamics employees. Verbal and physical sexual behavior will also not be tolerated. If a patron plays his/her explicit music loud enough for other patrons to hear then they are in violation of this policy. There should absolutely be no sexual touching or kissing in the facility.

VIOLATION OF POLICIES OR RULES

If any member or guest violates any of the Policies or Rules, Elevo Dynamics will ask that person to stop such behavior, or to leave, depending on the severity of the situation. A counseling statement will be written and signed from all parties and kept on file before the return of the parties involved. A member’s violation of any of the Policies or Rules may also cause Elevo Dynamics, in its sole discretion, to terminate that person’s membership and/or other agreements.

STERIOD WARNING

Use of steroids to increase strength or growth can cause serious health problems. Steroids can keep teenagers from growing to their full height. They can also cause heart disease, stroke, and liver damage. Men or women using steroids may develop fertility problems, personality changes, and acne. Men can also experience premature balding and development of breast tissue. There are civil and criminal penalties for the unauthorized sale, use, or exchange of anabolic steroids.
